The kitten will have a two week health guarantee which states that the kitten or cat will not have any genetic defects
which would be fatal if defects are found within two weeks the kitten may be exchanged. The stress the change of location,
fluctuation in temperature, environmental conditions to which the kitten may be exposed, exposure to other animals, airborne/latent/surface
bacteria and viruses, or exposure to disease or infection in any form, or many other sources of infection, may result in illness
to the kitten. Because of any or all of these circumstances and variables the health guarantee only cover fatal defects. The
Breeder will only attest, to the kittens Good Health at the point of release by pick up by the new owners. After that point,
the health and well-being of the kitten is the responsibility of the Purchaser. My cattery has no financial responsibility
to replace or exchange the kitten whatsoever. The Purchaser has two weeks from the change of Ownership from the Breeder to
the Purchaser, as described in detail, to have it examined by a Licensed Veterinarian of the Purchaser choice. If that Licensed
Veterinarian finds that the kitten suffers from a Fatal and Terminal disease or affliction, the Breeder will provide a replacement
kitten, subject to all the terms and conditions set forth in this Contract. Based upon the documentation provided by the
Purchaser and his Veterinarian, that must clearly indicate that the kitten arrived to the Purchaser with a Fatal and Terminal
illness, and after subsequent review by, and agreement to, the contents of that documentation by the Breeders Veterinarian,
the Breeder may authorize the return of the kitten. If the kitten dies a statement is required by your veterinary stating
the kitten did die and the cause. At that point, the Purchaser conditionally qualifies for a replacement kitten, subject to
a physical examination of the returned kitten by the Breeder Veterinarian, and subject to the terms and conditions stated
herein. The replacement kitten will provided, until the kitten being replaced is returned to the Breeder and the documented
claim by the Purchaser Veterinarian as to the kitten having a Fatal or Terminal disease is verified and agreed to by the Breeders
Veterinarian based upon a physical examination of the kitten. The Breeder assumes no responsibility for the cost of any medical
expenses for the examination of, or treatment of the Purchaser kitten for any reason throughout the Ownership of the kitten
by the Purchaser. Under no circumstances will the Breeder be responsible for a Refund to the Purchaser for either the Deposit
or the Purchase Price, or any part there of. Ownership of the kitten transfers to the Purchaser at the point of delivery or
in the case of a pickup by the Purchaser, at the point
the Purchaser leaves the Breeder location. The Breeder will send the Registration Papers to the Purchaser. Said Registration
Papers for kittens purchased as PETS will be marked NOT FOR BREEDING and NOT FOR SHOW. The cost of registration is the sole
responsibility of the Purchaser. If you purchase a kitten as a BREEDER, the registration papers will be sent to the Purchaser
as soon as is practicable based upon the turn around and processing times of TICA or CFA. Payment in full, in the payment
form described herein, Payment must be received by the Breeder prior to shipment, or in the case of pickup by the Purchaser,
must be made in the form of Cash at the time of pickup. For kittens being held with a deposit, the Purchaser must take possession
within 14 days of the available date and pay the balance in full upon notification of availability date by the Breeder. If
a kitten is not paid for in full and is not taken possession of by the Purchaser within the time frame identified above, the
Purchaser will forfeit the deposit and the Breeder is free to sell the kitten to another party. You the purchaser agree there
are no legal issues in which the purchaser would charge the seller with a law suit. The degree of hairlessness of the Sphynx
varies from cat to cat and sometimes from season to season. Hormones and genetics determine if a bald kitten will grow hair
as it gets older or after it has been spayed or neutered. It is impossible to guarantee that any Sphynx will not grow hair
at some point in time, and it is understood by the Purchaser that the Breeder makes no guarantee whatsoever as to the hairlessness
of the kitten. Similarly, a kitten with some degree of fuzzy hair may lose that hair as the kitten grows older, again, subject
to Hormones, Genetics, seasonal temperature fluctuations, spay or neuter. We the undersigned, agree with the terms and conditions
of this Contract, as stated herein, and wish to be legally bound by them. Furthermore, we the undersigned affirm that this
Contract constitutes the totality of the agreement between the Purchaser and Breeder.
